Gym Admin - Terms of Service

1. Acceptance of Terms
By accessing or using the Gym Admin application (the "Service"), whether through a mobile app or web interface, you agree to be bound by these Terms of Service ("Terms"). These Terms govern all use of the Service, and by using the Service, you represent that you have read and understood these Terms. If you do not agree to all the terms and conditions of this agreement, you should not use the Service.
2. Service Description
Gym Admin provides cloud-based gym management software designed for gym owners and staff to manage student attendance, belt tracking, scheduling, membership billing, and reporting. The Service includes an administrator dashboard and a separate Student App for self check-in and student profile management.
3. User Accounts and Responsibilities
3.1 Account Registration
You must provide accurate and complete information when registering for an account. You are solely responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.
3.2 Eligibility
The Service is intended for use by business entities, specifically gym and fitness facility owners or authorized personnel. By using the Service, you confirm you are 18 years of age or older and are authorized to enter into this agreement.
3.3 Data Handling
You are responsible for the legality, reliability, integrity, accuracy, and quality of the data and content you input into the Service ("Client Data"). Gym Admin is not responsible for any Client Data lost, corrupted, or inaccurate due to your misuse or error.
4. Payment and Billing
4.1 Subscription Plans
We offer a Starter Plan (Free) for up to 50 students. To manage more than 50 students, you must subscribe to a paid Monthly or Yearly plan, as detailed on our pricing page.
4.2 Billing and Fees
Subscription fees are billed monthly or annually, depending on the plan you select. All payments are processed through Stripe. By subscribing, you agree to Stripe's payment terms and conditions.
4.3 GST (Australia)
Unless expressly stated otherwise, all prices and fees displayed on the Service are inclusive of Australian Goods and Services Tax (GST), where applicable.
4.4 Transaction Fees
In addition to the subscription fee, a 1% Transaction Fee is charged by Gym Admin on all payments processed through the app, plus any standard payment processing fees charged by Stripe (which vary based on the payment method).
4.5 Cancellation and Refunds
You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing cycle. We do not provide refunds for any prepaid subscription period, including the annual plan.
5. Termination
We may terminate or suspend your account immediately, without prior notice or liability, if you breach the Terms, including but not limited to failure to pay fees when due. Upon termination, your right to use the Service will immediately cease.
6. Disclaimers and Limitation of Liability
The Service is provided on an "as is" and "as available" basis. Gym Admin makes no warranty that the Service will meet your specific requirements, or that the Service will be uninterrupted, timely, secure, or error-free.
Australian Consumer Law:
Nothing in these Terms is intended to exclude, restrict, or modify any non-excludable right or remedy you have under the Australian Consumer Law (ACL), including the consumer guarantees. Our liability for breach of a consumer guarantee is limited to supplying the services again or paying the cost of having the services supplied again.
To the fullest extent permitted by law, Gym Admin shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use or inability to use the Service.
7. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of New South Wales, Australia, and the Commonwealth of Australia. Both parties irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales.
